What is constructive dismissal in Ontario?

Constructive dismissal occurs when an employer makes a significant unilateral change to your employment terms — such as reducing pay, demoting you, or creating a hostile work environment. You may be entitled to treat this as a termination and claim severance as if you were dismissed without cause.

How is severance pay calculated in Ontario?

Severance is governed by the Employment Standards Act and common law. The amount depends on factors including length of service, age, position, and re-employment prospects. Many employers provide inadequate packages — we will advise whether your offer is fair.

Can my employer discriminate based on a disability?

No. The Ontario Human Rights Code prohibits discrimination in employment based on disability, and employers have a duty to accommodate employees with disabilities to the point of undue hardship.
