Common Questions

Do I need a lawyer for a separation agreement?
While you are not legally required to have a lawyer, it is strongly recommended. A separation agreement is a legally binding contract. Independent legal advice ensures you fully understand your rights, and that the agreement will be enforceable by a court.
How is child and spousal support calculated?
Child support is calculated using the Federal Child Support Guidelines, based primarily on the paying parent's income and the number of children. Spousal support is more discretionary and considers factors such as the length of the marriage, each spouse's income, and their respective roles during the relationship.
How long does a divorce take in Ontario?
An uncontested divorce — where both parties agree on all issues — can typically be finalised within four to six months. Contested divorces, where disagreements must be resolved through negotiation or litigation, can take considerably longer depending on the complexity of the issues.
